1. Definitions
In these terms and conditions, "Trivia Tapp" means the provider of the service, and "User" or "you" means the natural person or legal entity that purchases or uses the service.
2. Scope
These terms and conditions apply to all quotations, agreements and services provided by Trivia Tapp. By creating an account, using the service or entering into an agreement, you agree to these terms and conditions.
3. Services
Trivia Tapp provides an online trivia and quiz platform where you can participate in question rounds, challenges and other game modes, alone or with others. Depending on the features made available, you can earn points, ranks, badges or other (digital) rewards within the app.
The service is for entertainment and/or educational purposes only. The results, scores and questions in the app do not constitute professional advice of any kind (including but not limited to medical, legal or financial advice).
4. Account and verification
An account is required to access (parts of) the service. You must provide accurate and up-to-date information and carefully secure your account details. You are responsible for all activities that take place under your account.
5. Permitted use (Acceptable Use)
You are not permitted to use the service for:
- illegal purposes or activities that are in violation of applicable laws and regulations;
- disseminating unlawful, offensive, discriminatory, defamatory or otherwise harmful content;
- infringing the intellectual property rights or privacy rights of third parties;
- disrupting, bypassing or testing the security or availability of the service;
- generating misleading claims (e.g. medical, legal or financial advice) without expert validation.
6. Content and intellectual property
Unless otherwise agreed in writing, all intellectual property rights to the software, game concept, questions, graphics and other content in the platform are vested in Trivia Tapp or its licensors.
Subject to full payment of all fees due and compliance with these terms, Trivia Tapp grants you a limited, non-exclusive, non-transferable licence to use the app and its content for personal, non-commercial use. You may not copy, distribute, sell, resell or otherwise exploit any part of the app or its content without prior written permission.
7. User materials
If you submit or create material in the app (such as usernames, avatars, chat messages, custom questions or other content), you warrant that you have all necessary rights and permissions for this material and that it is not unlawful, offensive or otherwise in breach of these terms.
You grant Trivia Tapp a limited licence to use this material for the purpose of operating, promoting and improving the service, in accordance with our privacy policy. Where possible, we will respect your privacy settings and preferences.
8. Game content and accuracy of questions
We strive to keep the questions, answers and scores in the trivia app as accurate and up to date as reasonably possible. However, errors, ambiguities or outdated information may occur (for example due to changes in facts or interpretations over time).
Trivia Tapp does not guarantee that all questions or answers are correct, complete or suitable for any particular purpose. Participation in quizzes and use of any information obtained through the app is entirely at your own risk.
9. Game experience and rankings
The app may include rankings, leaderboards, achievements and other game elements. These are provided for fun and motivation only and have no cash value, unless explicitly stated otherwise. Trivia Tapp may adjust, reset or remove scores, rankings or game elements in case of suspected abuse, technical issues or to improve the game experience.
10. Fees, invoicing and payments
Rates, bundles and subscription types are stated in the application or quotation. Amounts are exclusive of VAT unless otherwise indicated. Payments are made via the payment methods we offer. In the event of late payment, access may be (temporarily) blocked and collection costs may be charged.
11. Subscriptions, termination and refunds
Subscriptions are automatically renewed per period unless otherwise stated. You can cancel according to the procedure indicated in the application before the end of the current period. Amounts already paid will not be refunded, unless required by law or expressly agreed otherwise.
12. Fair use and limits
To ensure quality and availability, Trivia Tapp may apply reasonable usage limits (for example on the number of games, questions, sessions, devices or virtual items that can be used within a certain period). Abuse, cheating, use of bots or other unauthorised tools, or excessive use that negatively affects other users may result in restricted access, removal of scores or accounts, or additional measures.
13. Availability and maintenance
Trivia Tapp aims for high availability, but does not guarantee uninterrupted operation. We may (temporarily) interrupt the service for maintenance, updates or emergencies. We are not liable for damage resulting from interruptions or malfunctions.
14. Support
We provide reasonable support through the channels listed in the application. Response times are best-efforts obligations and not result obligations, unless agreed otherwise.
15. Liability
To the extent permitted by law, the total liability of Trivia Tapp is limited to the amount you have paid for the service in the three (3) months preceding the event. Trivia Tapp is not liable for indirect damage, consequential damage, loss of profit, missed savings, reputational damage or loss of data.
16. Indemnification
You indemnify Trivia Tapp against claims from third parties arising from or related to your use of the service, your material, or violation of these terms or applicable laws and regulations.
17. Privacy and data processing
We process personal data in accordance with our privacy policy and applicable legislation (including the GDPR, where applicable). For certain services, a data processing agreement may be offered or required.
18. Security and confidentiality
Trivia Tapp takes appropriate technical and organisational measures to secure the service. However, no measure can guarantee absolute security. The parties will treat each other's confidential information as strictly confidential.
19. Term and termination
You can terminate your use at any time by closing your account. Trivia Tapp may suspend or terminate the agreement (in whole or in part) if you breach these terms, if required by law or in the event of abuse or fraud.
20. Changes to the service and terms
We may change the service and/or these terms from time to time. Material changes will be announced in advance where reasonable. Continued use after the changes take effect constitutes acceptance of those changes.
21. Governing law and disputes
These terms are governed by the laws of the Netherlands, unless mandatory law provides otherwise. Disputes will be submitted to the competent court in the district where Trivia Tapp is established, unless mandatory law provides otherwise.
22. Force majeure
Neither party is obliged to perform any obligation if it is prevented from doing so due to force majeure, which includes failures of suppliers, power or internet outages, pandemics, cyber attacks or government measures.
